New rules coming into force in Northern Ireland this month restricting the use of red diesel have been criticised by food industry leaders.

The Northern Ireland Food and Drink Association has said that the move will lead to significantly increased costs for chilled and frozen transport, with no additional environmental benefit, and amounts to a ‘tax on food’.

Red diesel will only be allowed for use in agriculture, rail transport and non-commercial heating.

Michael Bell, Executive Director, Northern Ireland Food and Drink Association (NIFDA) said: “This is not about the government making the food supply chain more sustainable. There is no difference in terms of environmental impact between red or white diesel, and in the absence of commercially viable alternatives for refrigeration this move amounts to a tax on food.

“The food supply chain is not in a normal position at present and the whole supply chain is struggling to keep a lid on prices. Further taxing food distribution in this way at this time could have serious consequences not just for businesses here, but for consumers too.

“The war in Ukraine has caused a serious ripple effect on the global food system, causing supply chain disruption and price increases. Fuel prices are hurting consumers too, particularly in Northern Ireland where we have some of the most vulnerable people in the United Kingdom. Pressing ahead with a tax on food when families across the UK are experiencing a cost of living crisis will have devastating consequences.

“I raised this issue with Northern Ireland Office minister Conor Burns last week, and NIFDA will continue to press the government to see sense on this issue.”

New rules restricting the use of red diesel come in today (April 1) but have been branded a government “cash grab dressed up as an environmental measure” by a representative of the construction sector.

Red diesel is standard diesel but taxed at a lower rate and dyed red to make it easily identifiable and is heavily used in the construction and manufacturing industries.

However, these industries will no longer be able to use it under new rules HM Revenue and Customs said are designed to help meet “climate change and air quality targets”.

Companies in those industries that use rebated red diesel in their vehicles and equipment will have to switch to standard diesel and pay more for their fuel.

Gordon Best, from the Mineral Products Association NI, said it will have a “significant” impact.

He said the cost of materials and spending in the food sector would increase as a result.

“People know red diesel is just white diesel with a dye so this not about the environment,” he said.

He said the move was “the correct policy at the wrong time”, as there are issues with the technology used in large industry vehicles and the unavailability of zero carbon fuels such as green hydrogen.

“We said: ‘At least phase out the rebate’,” he added.

“The cost to the Northern Ireland economy is going to be about £25m and it’s felt money would be better spent on energy transition in Northern Ireland.”

He claimed the move would affect businesses in rural areas that cannot connect to the electricity grid, which use generators fuelled by red diesel to create power, and significantly increase the risk of theft.

From 1 April 2022, red diesel can only be used for the following purposes:

  • For vehicles and machinery used in agriculture, horticulture, fish farming and forestry. This includes allowing vehicles used for agriculture to be used for cutting verges and hedges, snow clearance and gritting roads
  • To propel passenger, freight or maintenance vehicles designed to run on rail tracks
  • For heating and electricity generation in non-commercial premises, this includes the heating of homes and buildings, such as places of worship, hospitals and town halls; off-grid power generation and non-propulsion uses on permanently-moored houseboats
  • For maintaining community amateur sports clubs, as well as golf courses (including activities such as ground maintenance, and the heating and lighting of clubhouses and changing rooms)
  • As fuel for all marine craft refuelling and operating in the UK (including fishing and water freight industries), except for propelling private pleasure crafts in Northern Ireland
  • For powering the machinery (including caravans) of travelling fairs and circuses.

The Ulster Farmers’ Union (UFU) says the changes made to using rebated fuels guidance  by HMRC which will continue to allow tractors participating in tractor runs to use red diesel from 1 April 2022, will be well received by the farming community.

The guidance on ‘Using rebated fuels in vehicles and machines’ (Excise Notice 75) has now been amended and will allow tractor runs, ploughing matches and agriculture shows to continue as activities accepted as ‘purposes relating to agriculture, horticulture and forestry’. 

The updated guidance states that activities falling within the definition of agriculture will include ‘running or participating in events which provide information and education that benefit agriculture, horticulture or forestry, including taking part in charitable activities that promote these industries’.

UFU deputy president David Brown said, “HMRC has made the right decision by including tractor runs, in addition to shows and ploughing matches as activities that provide information, education and raise money for charity. This will be well received by our members and rural communities that host tractor runs and many other agri events to raise vital funds for charities across Northern Ireland. 

“Earlier in the month, HMRC backtracked on changes to red diesel usage rules, to include ploughing matches and agricultural shows but left out tractor runs. We outlined our disappointment to HMRC that tractor runs organised as charity events or for educational purposes, were not included in this amendment and it’s encouraging that they reviewed this position following pressures from the industry and politicians. It’s good that common sense has prevailed and our rural communities can continue to raise essential funds through tractor runs and other agri events.”
